ENGINE SHED PHOTO COMPETITION: TERMS AND CONDITIONS
When you enter one of our competitions, you agree to the terms and conditions.
1. The Promoter
1.1. The Promoter of this competition is Historic Environment Scotland, an executive non-departmental public body, incorporated and established under the Historic Environment Scotland Act 2014, being a registered charity (Scottish Charity number SC045925) and having its principal office at Longmore House, Salisbury Place, Edinburgh, EH9 1SH.
2. The Competition
2.1. These terms and conditions apply to the Engine Shed Doors Open Day photography competition, running on the Engine Shed website www.engineshed.scot and related social media channels (the “Competition”), and also advertised on the Doors Open Day website 2018 www.doorsopendays.org.uk and related social media channels.
2.2. Competition entries must be photographs of buildings located in the Stirling Council area.
2.3. Entries must not include photographs of people, from which people can be identified.
2.4. The Competition will run until 23.59 on 17 September 2018. Entries to the Competition must be received within this timeframe to be potentially eligible for inclusion.
2.5. Each entrant must submit a minimum of one and a maximum of six photographs to the Competition (“Entry”/”Entries”).
2.6. All Entries must be submitted as digital files. Entries should be high resolution and submitted by email to email@example.com with the subject line “Photo Competition”.
2.7. All Entries are sent at the photographer’s own risk and Historic Environment Scotland cannot accept liability for damage or loss to entries. Entries will not be returned to entrants.
2.8. The judging panel shall include an employee from Scottish Civic Trust, organisers of Doors Open Day. Full names of the judging panel are available on request. The decision of the judges is final.
2.9. The winning entrant’s name and county will be available on request for 30 days after the winning entry has been selected, to comply with applicable rules. By entering this Competition, each entrant, or if the entrant is under 18 years old, the entrant’s parent or guardian, consents to their name and county being made available in this way.
3. The Prize
3.1. The entrant of the winning Entry will receive tickets for admission to Stirling Castle for a day for up to four people, including lunch at Stirling Castle for up to four people (lunch being limited to a maximum value of £50).
3.2. This prize is not transferable or exchangeable and cannot be taken as cash. In the event the winner does not for any reason take an element of a prize then that element of the prize will be forfeited by the winner and cash or any other form of compensation will not be supplied in lieu of that element of the prize.
4. Exhibition of top entries
4.1. The winning Entry and a selection of other Entries submitted to this Competition may be displayed in an exhibition at the Engine Shed in Stirling in 2018 or 2019 (the “Exhibition”).
4.2. Entries may be featured in Historic Environment Scotland’s publicity materials, including but not limited to on the Engine Shed and Historic Environment Scotland websites and social media channels, specifically Facebook, Twitter and Instagram.
5. Notification of winning entries
5.1. The winner will be notified by 17 October 2018 by email.
5.2. If the winner is unable to be contacted after reasonable attempts, Historic Environment Scotland reserves the right to offer the prize to a runner-up.
5.3. Entrants whose Entries are being displayed at the Exhibition will be notified by 17 October 2018 by email.
6.1. The Competition is not open to employees of Historic Environment Scotland or Scottish Civic Trust (organisers of Doors Open Day), or their immediate families.
7. Consents and copyright
7.1. All Entries must have been legally obtained by the entrant. By entering this competition, each entrant, or if the entrant is under 18 years old, the entrant’s parent or guardian, warrants and represents to Historic Environment Scotland that they have obtained all necessary third party consents or permissions relating to any Entries submitted to the Competition.
7.2. Entrants must be the sole author and owner of copyright in all Entries entered by them into the Competition. By entering this competition, each entrant, or if the entrant is under 18 years old, the entrant’s parent or guardian, warrants and represents to Historic Environment Scotland that any Entries submitted to the Competition do not infringe the rights of any third parties, including, without limitation, copyright.
7.3. Ownership of copyright in each Entry will remain with the Entrant. In consideration of entering the competition, each entrant , or if the entrant is under 18 years old, the entrant’s parent or guardian, grants to Historic Environment Scotland a worldwide, non-exclusive, perpetual, irrevocable and royalty-free licence to reproduce, distribute and/or communicate to the public each Entry.
8. Data protection
8.1. The legal bases for which Historic Environment Scotland will collect personal data in respect of Competition entrants are (i) its legitimate interest of administering the Competition, and (ii) to comply with its legal obligations in respect of competitions.
8.2. HES will use the personal data of Competition entrants as follows:
8.2.1. To contact the winning entrant and entrants whose Entries are selected for the Exhibition;
8.2.2. To identify an alternative winning entrant if the winning entrant cannot be contacted within a reasonable time; and
8.2.3. To identify the winning entrant and entrants whose Entries are selected for the Exhibition as (i) authors of their Entries at the Exhibition and in publicity materials which make use of the Entries; and (ii) in response to requests for the identity of the winning entrant.
8.3. Historic Environment Scotland will use personal details that entrants provide to us in line with our Engine Shed Privacy Notice, which is available at https://www.engineshed.scot/privacy-notice/.
8.4. The personal data of Competition entrants will be retained until the winner has claimed their prize and the Exhibition has taken place.
9.1. These rules are governed by the laws of Scotland. By entering into this competition, each entrant agrees to submit to the exclusive jurisdiction of the Scottish courts.
9.2. Historic Environment Scotland reserves the right to disqualify any entrants that breach these rules or any entries that, in the sole opinion of Historic Environment Scotland, are in any way fraudulent or otherwise unlawful or would damage the reputation of Historic Environment Scotland.
9.3. Historic Environment Scotland reserves the right to cancel this competition at any time.
Historic Environment Scotland reserves the right to amend these rules without notice by posting changes to the website www.engineshed.scot. We will only notify entrants of changes if we are required to do so by law.
